“Weekly Win Your Wishlist” Sweepstakes (the “Sweepstakes”) is sponsored by Windsor Fashions. (“Sponsor”), 9603 John Street, Santa Fe Springs CA 90670.

Prize

The Sweepstakes will award to the winner a prize valued at approximately $50 USD, one per drawing. The prize will be given in the format of a Windsor gift card. Prize award requires compliance with the terms and conditions contained in these Official Rules. Can be redeemed on Windsor mobile App, windsorstore.com or at any of our 300+ retail locations throughout the United States. Gift card orders cannot be canceled, returned or exchanged. Cannot be used to purchase additional gift cards or redeemed for cash. Purchases made with a gift card and returned will be credited back to the original gift card used at time of purchase.

Eligibility

How to Enter 

No purchase is necessary to enter or win the Sweepstakes. Limit one entry per person. To enter, log in to your Windsor Mobile app. Then, click on items to save to your wish list.  You must save an item each week and save one (1) item to your wishlist to be entered for that week.  (as a quick save or to a list). The Sweepstakes is open only to legal residents of the 50 United States and District of Columbia who are 18 years of age or older, or the age of majority in their state of residence, whichever is older, at the time of entry, as confirmed by a valid government-issued photo identification. Employees of Sponsor, and direct family members of those employees are not eligible to win the Sweepstakes. You must have a valid email address and a Windsor mobile app account to enter the Sweepstakes.

Alternative Method of Entry

No purchase is necessary to enter or win the Sweepstakes. To enter, send an email during the Promotion Period to [e-mail] that contains your first name, last name, email address, street address, city, state, zip code, and daytime phone number, with a subject line of: "Weekly Win Your Wishlist". All parts of an entry must be filled out correctly; incomplete entries or illegible entries are void. Limit one entry per person. Entries are the property of Sponsor and will not be returned.

Disclaimer

Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation, theft, destruction or alteration of, or unauthorized access to, entries. If for any reason this sweepstakes is not capable of running as planned due to any causes beyond the control of Sponsor, including without limitation any circumstances that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to terminate, modify, or suspend the Sweepstakes. Sponsor may edit these Officials Rules from time to time as they deem necessary. Sponsor reserves the right to make the sole determination as to whether an entry was entered properly and qualifies for the Sweepstakes.

Entry Period: 

The Giveaway shall run weekly starting each Sunday at 12:00 AM PST, and ending 11:59 PM PST each Saturday (the "Giveaway Period").

Winners

Selecting Winner

Winners will be announced every Monday before 12:00 PM PST. One winner will be selected from all eligible registered entrants in a random drawing from valid entries received for each drawing shortly following the end of the Promotion Period. Odds of winning depend upon the number of valid entries received. 

The winner will be notified around the time of the prize drawing via email. If the winner does not claim the prize within two (2) business days following the notification, the winner will forfeit the prize and a new drawing will be conducted with an alternate winner selected. This process will continue until a winner claims the prize.

By accepting the prize, the winner agrees that Sponsor, its affiliates, distributors, partners, consultants, agents, and all of their respective officers, directors, employees, representatives and agents will have no liability for, and the winner shall hold all such parties harmless against damage, loss or injury that may arise in whole or in part, directly or indirectly, from, the winner’s acceptance, possession, use or misuse of prizes, participating in any prize-related activity, or participation in the Sweepstakes. All entrants have an equal chance of winning regardless of method of entry.

The winner agrees to provide to Sponsor any required tax form, including Form W-9, or other information reasonably requested by Sponsor relating to the award of the prize, prior to the award of the prize. Sponsor will furnish to the Internal Revenue Service any required tax reporting forms relating to the award of the prize, including Form 1099-MISC.

Prize Restrictions 

Winner is solely responsible for all taxes, fees, and insurance expenses, if any. Tax may be withheld on the prize when applicable. No prize substitution, cash substitution, assignment or transfer of the prize is permitted, except that Sponsor may substitute a prize of equal or greater value in the event it deems necessary. All prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied, except as provided by the supplier. The winner will look solely to the supplier of the prize for any supplier warranties that might accompany the prize.

Violations of Rules

Sponsor reserves the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be tampering with the entry process or the award mechanism by any other means or to be acting in violation of these rules. Any person attempting to defraud or tamper with Sweepstakes in any way will be ineligible for prizes and may be prosecuted to the full extent of the law.

Limitations on Liability 

EACH ENTRANT AGREES THAT SPONSOR AND ITS AFFILIATES, DISTRIBUTORS, PARTNERS, CONSULTANTS, AGENTS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INJURY, LOSS OR DAMAGE OF ANY KIND RESULTING FROM THIS SWEEPSTAKES OR ENTRANT’S PARTICIPATION IN THIS SWEEPSTAKES, THE ACCEPTANCE, POSSESSION OR USE OF THE PRIZE OR PARTICIPATING IN ANY PRIZE-RELATED ACTIVITY. ENTRANTS WAIVE ALL RIGHT TO, AND HOLD THE SPONSOR HARMLESS FROM, ANY CLAIM, LIABILITY, LOSS, DAMAGE (INCLUDING PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES), OR EXPENSE (INCLUDING ATTORNEYS' FEES) ARISING OUT OF OR IN CONNECTION WITH PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, USE, OR MISUSE OF ANY PRIZE HEREUNDER. EACH ENTRANT FURTHER AGREES THAT SPONSOR AND ITS AFFILIATES, DISTRIBUTORS, PARTNERS, CONSULTANTS, AGENTS, AND EMPLOYEES ARE NOT RESPONSIBLE FOR TYPOGRAPHICAL OR OTHER ERRORS IN THE OFFER OR ADMINISTRATION OF THIS SWEEPSTAKES, INCLUDING BUT NOT LIMITED TO ERRORS IN THE OFFICIAL RULES, THE SELECTION AND ANNOUNCEMENT OF THE WINNER, OR THE DISTRIBUTION OF THE PRIZE. SPONSOR RESERVES THE RIGHT TO MODIFY THESE RULES FOR CLARIFICATION PURPOSES WITHOUT MATERIALLY AFFECTING THE TERMS AND CONDITIONS OF THE SWEEPSTAKES WITHOUT ENTRANT NOTIFICATION.

Disputes/Choice of Law
Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts situated in Seattle, Washington; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits, may be awarded (collectively, “Special Damages“), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. The laws of the State of Washington, without reference to Washington’s choice of law rules, governs the Sweepstakes and all aspects related thereto.

Consent to use information
Each entrant specifically acknowledges and agrees that Sponsor and its affiliates, distributors, partners, consultants, agents, advertising and promotional agencies, and suppliers may utilize information obtained from the entrant, including but not limited to, to contact him or her and/or to offer their products or services or for other promotional purposes. By submitting an entry, each entrant consents to the use of his or her name, likeness, biographical information, photograph, video (including the use and appearance of entrant’s photograph and video on the web site of Sponsor, and its affiliates and partners), and voice in this and future promotions and publicity without further compensation. This consent is void where prohibited by law. Personal information provided in conjunction with a Sweepstakes entry is subject to Sponsor’s privacy policy, available here. 

Miscellaneous
The Sweepstakes is subject to all applicable federal, state, provincial, and local laws. Void where prohibited. Sponsor shall be entitled to interpret these rules as needed, including but not limited to rules regarding entries, selection of winner, deadlines, restrictions on the prize, and eligibility, and all of its decisions are final. Sweepstakes entrants agree to be bound by all interpretations of the rules by Sponsor and all decisions of Sponsor in connection with the Sweepstakes. The Customer Feedback Giveaway 2025 ("the Giveaway") is created and sponsored by Windsor Fashions, LLC ("Sponsor" or "Windsor"), 9603 John St., Santa Fe Springs, CA 90670. By participating in the Giveaway, you agree to the terms and conditions of the Windsor website, including the Privacy Policy, which are available https://customerserviceportal.windsorstore.com/hc/en-us/sections/4421725201421-Terms-Conditions, incorporated herein by reference, and that your participation will be governed by, and you shall abide by, all of the following rules (the "Giveaway Rules") outlined herein.

If there is a dispute as to the identity of an entrant, the Prize (defined below) will be awarded to the authorized account holder of the email address account provided when an Entry (defined below) was made. Windsor shall have no liability for a winner's failure to receive notices due to winners' failure to check their inbox; due to spam, junk e-mail or other security settings; or for winners' provision of incorrect or otherwise non-functioning contact information. Windsor may in its discretion announce the name of the potential Winner on www.windsorstore.com or in other forms of communication. The receipt by any winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations.

The failure of a potential winner promptly to prove eligibility, sign the required declaration and grant of rights in the Entry, or Windsor's inability to contact the potential winner, will result in immediate disqualification and selection by Windsor of an alternative winner.

ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNERS DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering the Giveaway), and participant further waives all rights to have damages multiplied or increased.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, IN NO EVENT WILL THE SPONSOR OR THE SPONSOR PARTIES BE LIABLE TO ANY PARTICIPANT OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF REVENUES, LOST PROFITS, LOST CAPITAL OR OVERHEAD, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WHETHER OR NOT SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

User Content and Grant of Rights: Windsor loves your suggestions and feedback as Windsor uses it to improve customer experience online and in Windsor's stores.  By providing your suggestions and feedback related to your customer experience at Windsor  in response to the survey (the "Submission") you automatically grant Windsor Fashions Inc, LLC a royalty-free, irrevocable, transferable, sublicensable, and non-exclusive perpetual license throughout the universe to use the comments, artwork, and any related text (“User Content”) in connection with the Windsor website(s), social media accounts, emails to Windsor customer list, advertisements, and other Windsor promotional materials, including paid advertising (collectively, “Windsor Media”). For avoidance of any doubt, this means that Windsor may post, repost, share, and otherwise distribute and reproduce the User Content in all Windsor Media, now known or hereafter devised, including alongside and in combination with promotions for third party brands and products. 

You also waive to the full extent permitted by law any and all claims against us related to moral rights in the User Content. In no circumstances will we be liable to you for any exploitation of the User Content. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish and exploit the User Content, for promotional purposes, including, without limitation, copyright, trademark, and rights of publicity and privacy. You affirm, represent, and warrant that your Submission and the User Content is in compliance with all terms and conditions of any third party website or application on which you post the Submission.

You shall not make any Submission that is inappropriate, indecent, obscene, hateful, tortious, defamatory, disparaging of Windsor or any other brand or individual, or that promotes discrimination on the basis of race, gender, religion, nationality, disability, sexual orientation, or age.

You agree to indemnify, defend, and hold harmless Windsor from and against any and all third-party claims, damages, liabilities, costs and expenses, including legal expenses and reasonable attorneys' fees, arising out of your Submission. You agree to be bound by the www.WindsorStore.com Terms of Service, located at https://customerserviceportal.windsorstore.com/hc/en-us/articles/24258330875405-Contest-Terms-Conditions, which are herein incorporated by reference.

You agree that Windsor may, but is under no obligation to feature the User Content on Windsor Media, and should Windsor choose to feature the User Content, Windsor may, at its sole discretion, elect to remove the User Content from Windsor Media at any time and without notice to you.

Eligibility: The Giveaway is open only to individuals who (a) are legal residents of the United States or the District of Columbia, and (b) as of the date of the individual's first Entry, are at least thirteen (13) years old with permission from a parent or legal guardian, or are at least eighteen (18) years old. Sponsor in its discretion may require a person who submits an Entry ("Participant") to provide verification of eligibility. The following individuals are not eligible to enter or win the Giveaway: current or former (within the immediately preceding 12 months) employees, officers, directors, and contractors of Windsor Fashions, LLC., and anyone involved in the administration of the Giveaway, and any member of the immediate family (i.e., a parent, sibling, child or grandchild) or household of any of the foregoing individuals.

Entry Period: Entries will be accepted starting at 12:01 a.m. Pacific Time, January 1, 2025 and ending 11:59 p.m. Pacific Time, December 31, 2025 (the "Giveaway Entry Period"). The timestamp generated by Research.Net website shall be the official time-keeping device for the Giveaway

How to Enter: All Entries shall be submitted through the survey located at https://www.research.net/r/WindsorWebsiteCustomerFeedback, except as discussed below. Individuals must have and provide a valid email address in order to participate in the Giveaway.

By submitting an Entry, you warrant and represent that your Entry is original and does not infringe the intellectual property rights of any third party, you own or have the necessary licenses, rights, consents, and permissions to publish and exploit the Entry, the Entry does not feature trademarks, logos, or brand names other than Windsor, and the Entry is not made for any improper purpose such as to intimidate or harass any individual or to ridicule, disparage, or embarrass Windsor.

No Entry shall contain any language or imagery which Windsor deems, in its sole and absolute discretion, to be inappropriate, indecent, obscene, hateful, tortious, defamatory, or that promotes discrimination on the basis of race, gender, religion, nationality, disability, sexual orientation, or age. Windsor reserves the right, in its sole discretion, to disqualify any Entry that contains any such language or imagery or which otherwise may be in violation of any law. Late, incomplete and/or inaccurate entries and entries not complying with all rules are subject to disqualification. Any form of automated entry, including by the use of macros, scripts or bots, will be disqualified. Furthermore, by entering, each Participant represents and warrants that each Entry complies with these Giveaway rules ("Rules") in full. Entries must not contain any material that Windsor, in its sole discretion, deems inappropriate for public viewing and/or determines is contrary to the Giveaway mission. Windsor reserves the right in its sole discretion to disqualify and/or not accept any Entry that Sponsor determines does not or is likely not to comply with these guidelines.

Your submission of an Entry constitutes your legal representation that you are eligible to participate in the Giveaway and that you have read and agree to be bound by these Rules.

All Entries must be submitted no later than 11:59 pm Pacific Time on December 31, 2025.

Selection and Chance: There will be one (1) winner ("Winner") each week. Winners will be drawn randomly each week from the participants the prior week.

Winner Notification, Requirements, and Grant of Rights: Windsor will notify each week's Winner by emailing the Winners (the "Notification"), on the first Thursday of each month following the Weekly Periods in which the survey was completed. To claim the Weekly Prize (defined below), Winner must respond to the Notification within forty-eight (48) hours of its sending by replying to the email with the Winner's full legal name, home, and email addresses. By accepting the gift card the Winner releases rights to Windsor without additional compensation.

Prize: There shall be one (1) prize awarded for each week during the Entry Period (the "Weekly Prize") consisting of one gift card in the amount of $100.00 (Weekly Prize ARV: $10.00). No cash or other prize substitutions are permitted except at Sponsor's sole discretion. The prize is non-transferable. Any and all prize related expenses, including, without limitation, any and all federal, state, and/or local taxes shall be the sole responsibility of each Winner. Gift card shall be subject to the terms and conditions delivered with the gift card.

Limitation of Liability: 

UNDER NO CIRCUMSTANCES SHALL WINDSOR AND ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS, DIRECTORS BE LIABLE TO YOU FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (EVEN IF SUCH DAMAGES ARE FORESEEABLE, AND WHETHER OR NOT WINDSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING FROM ANY ASPECT OF THE RELATIONSHIP PROVIDED FOR HEREIN.  EXCEPT AS PROVIDED HEREIN, WINDSOR MAKES NO REPRESENTATIONS, AND HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.

By entering, each Participant agrees to  hold harmless Windsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (all of the foregoing, the "Sponsor Parties") from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such participant's participation in the Giveaway and/or her acceptance, possession, use, or misuse of any Prize or any portion thereof, (ii) technical failures of any kind, including but not limited any loss or damage to any Entry, (iii) the malfunctioning of any computer, cable, network, hardware or software; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the entry process or the Giveaway; (vi) electronic or human error which may occur in the administration of the Giveaway or the processing of Entries; (vii) any defect of the Prize, known or unknown; (viii) any product warranty, express or implied to the maximum extent allowed by law. Some jurisdictions may not permit certain liability limitations or waivers. If any court determines the law of such a jurisdiction applies, our liability shall be limited to the greatest extent permitted by law.

All Decisions Final: All decisions of Sponsor and Sponsor Parties are final and binding in all respects.

Disputes: THE GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in the Giveaway, to the fullest extent allowed by law, you agree that any and all disputes, claims, causes of action or controversies arising out of or in connection with the Giveaway, shall be resolved in arbitration individually and without resort to collective, class, or aggregate action, as set forth in the Terms and Conditions of the www.windsorstore.com website. By registering and/or submitting an Entry, you irrevocably waive, to the greatest extent allowed by law, any right to seek and/or obtain rescission and/or equitable and/or injunctive relief.

General Terms and Conditions: All federal, state, and local laws and regulations apply, and the Giveaway is void where prohibited. Windsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Windsor may select the recipients from all eligible Entries received prior to and/or after (if appropriate) the action taken by Windsor. Windsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or who violates these Giveaway Rules. Sponsor is not responsible for lost, late, illegible, incomplete, damaged, mutilated, misdirected, mis-delivered, or delayed Entries, or for technical or human errors or failures of any kind in connection with the submission, transmission, processing or selection of Entries or the winning Entry, including without limitation any malfunctions or failures of computer hardware, computer software, networks or telephone equipment or any technical problems or traffic congestion on the Internet or at any website or late, lost, damaged, or postage due mail, or any combination thereof. Caution: Any attempt by a person to deliberately damage any website or undermine the legitimate operation of the Giveaway is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway, or in the announcement of the Prize. Sponsor shall not be responsible for retaining copies of any Entry. These Giveaway Rules set forth the entire agreement and understanding between Sponsor and Participant concerning the subject matter hereof and merges and supersedes all prior discussions, agreements, and understandings of any kind between them. Notwithstanding anything contained herein to the contrary, Sponsor reserves the right, in its sole discretion, at any future time to terminate, modify, or suspend the Giveaway for any reason, in Sponsor's sole discretion. Participant shall be deemed an independent contractor and nothing contained herein shall constitute this arrangement to be employment, a joint venture, or a partnership. Sponsor's failure to enforce any provision of these Giveaway Rules shall not constitute a waiver of any provision contained herein. If any provision of these Rules is found to be invalid or unenforceable by a court of competent jurisdiction or appointed arbitrator, such determination shall in no way affect the validity or enforceability of any other provision herein. The titles of Sections of these Giveaway Rules are for convenience only and shall not be given any legal effect. The word "including" is used in these Giveaway Rules to mean "including but not limited to."

Notifying Winner: Each week's Winner will be contacted via the provided email and given a promo code once. If you win, you consent and release Windsor from any liability associated with announcing your name as a winner of the Giveaway

By using Windsor's hashtags such as #yesWindsor, #windsor, #windsorstore, #windsorprom, #windsorgirlsweeps and other hashtags involving the brand name "Windsor" or tagging Windsor on a public social media post or/and by submitting content to Windsor through Windsor's website, you automatically grant Windsor Fashions, LLC and you represent and warrant that you have the right to grant, to Windsor Fashions, LLC an irrevocable, perpetual, non-exclusive, royalty-free, worldwide license to use, telecast, copy, perform, display, reproduce, edit, distribute, copy, edit, change, modify, add to, subtract from and otherwise exploit the User  Submissions, or any portion thereof, in any manner (including without limitation promotional and advertising purposes) and in any and all media now known or hereafter devised, and to prepare derivative works of, or incorporate into other works, such User Submissions, and to grant and authorize sublicenses of the foregoing without any compensation to you or to any third party.

If you make a User Submission, you represent and warrant that you own or otherwise control the rights to your User Submission. By making a User Submission, you hereby warrant that your User Submission is your original creation, has not been copied, recreated, reproduced, previously published, derived from or otherwise taken in whole or in part from any other work and the User Submission does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws or regulations. You also warrant and represent that each person in the Submission has given their written permission and consent to be included in the Submission and displayed publicly on Windsor's Website and other Windsor's social media sites and marketing materials and advertising and that you shall furnish such permission and consents promptly to Windsor upon request.

You agree not make any User Submission that is inappropriate, indecent, obscene, hateful, tortious, defamatory, disparaging of Windsor or any other brand or individual, or that promotes discrimination on the basis of race, gender, religion, nationality, disability, sexual orientation, or age.

You agree to be bound by the  , which are herein incorporated by reference.

You agree to indemnify Windsor and its affiliates for all claims arising from or in connection with any claims to any rights in any User Submission or any damages arising from any User Submission. You further agree to indemnify and hold Windsor, its officers, directors, and employees (collectively the “Releases“) harmless from any and all claims by any third party against any of the Releases (and related damages, expenses, costs, including reasonable attorney’s fees, liabilities, verdicts, judgments and settlements) arising out of use of a User Submission or any breach of your representations herein, including but not limited to claims of infringement or violation of trademark, copyright, or other intellectual property rights, rights of publicity, or rights of privacy. Upon submission of User Submission you hereby release Windsor and Releases from, and irrevocably waive, any and all claims that Windsor use of your User Submission with or without your name, including but not limited to use on Windsor's website, infringes or violates your rights in your User Submission or any work or material contained in your User Submission.

Windsor may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Submissions in any manner in its sole discretion, with no obligation to you whatsoever. You acknowledge and agree that Windsor has no obligation to compensate you for use of your User Submissions. You grant Windsor the right to use your username, real name, image, likeness, caption, location or other identifying information in connection with any use of your User Submissions. Please note that any User Submission posted to any Windsor's website or tagged with Windsor's hashtag may be used by Windsor for commercial purposes and may be copied or exported from any of the Windsor controlled websites or social medial pages and platforms and published elsewhere on the internet, including on any social media sites, or otherwise so please exercise discretion in deciding what to post on Windsor's website or using Windsor's hashtags.

Windsor does not endorse or control the User Submissions transmitted or posted on the Windsor's website and therefore, Windsor does not guarantee the accuracy, integrity or quality of User Submissions. You understand that by using this, or any other of the Windsor's websites or social media pages, you may be exposed to User Submission that is offensive, indecent or objectionable to you. Under no circumstances will Windsor be liable in any way for any User Submission, including, without limitation, for any errors or omissions in any User Submission, or for any loss or damage of any kind incurred by you as a result of the use of any User Submission transmitted, uploaded, posted, e-mailed or otherwise made available via the Windsor's website or social media.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, NEITHER WINDSOR NOR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES IS LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS ARISING OUT OF YOUR ACCESS TO, OR USE OF, THE WINDSOR WEBSITE OR SOCIAL MEDIA PAGES EVEN IF WINDSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WINDSOR'S WEB SITE OR SOCIAL MEDIA PAGES IS PROVIDED TO YOU “AS IS“ WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
